Possibly because then they can do it to anyone. All they'd have to do is come up with some "evidence" that someone was guilty of something. Another point is, what if that person was innocent, and after suffering from side effects of the testing, they were found to be innocent?

Testing on people on death row, could lead to testing on people in prison period, which means, you could forget to pay taxes, or get a DUI, or be accused of something, sent to prison, and tested on, for even the slightest thing, the scenario of testing on people on death row could easily lead to one of those worlds you read about in dystopian fiction.
